Carriage of Dangerous Goods Prohibition Notices – Most Frequent None Compliances

Thursday July 2024

The Carriage of Dangerous Goods Prohibition Notices issued by either the Police, DVSA or Department for Transport are published on the HSE website to be viewed by all!

A very interesting read it is too, intrigued to find out more … what are the most common types of non-compliances issued?

After a small sample study of recent prohibition notices issued the following league table sets out the most common types of non-compliances!

Equipment 25%
Fire Extinguishers 23%
Transport Documents 20%
Marking & Labelling 14%
Insecure Load 7%
Construction 6%
Training 5%

Lets consider the top 3 in more detail, to understand what these non-compliances include!

Equipment relates to the vehicle not being equipped so that the driver can take those measures detailed in the emergency information and, in the case of the carriage of toxic gases, to enable the crew to escape.

In Chapter 8.1.5 of the ADR Regulations 2023 it clearly states the different type of vehicle equipment required for general and personal protection.  If you require a copy of this information, then please contact us.

The Fire Extinguisher prohibition notices related to:

  • Not being readily available, i.e. locked away
  • Not having sufficient quantity or partial discharge
  • Out of service
  • Unsuitable for the type of load

The ADR Regulations in Chapter 8.1 4 are very explicit on what is required, depending upon the size of vehicle.  If you require details on your exact needs, to ensure you don’t get caught out with any of these non-compliances, then please contact us.  It really is an easy fix!

The term Transport Documents doesn’t just include the transport document, but a list of other documents to be carried/accessed by the driver.  The main area of non-compliance was not having access to ‘instructions in writing’ relating to the dangerous goods on board the vehicle, to be used in the event of an accident / incident.   In ADR 2023 Chapter 5.4.3.4, a 4-page model is available to use.  Once again, if copies are required then please contact us.
